ARTICLE 1: COMPANY IDENTITY

ARTICLE 2: APPLICABILITY AND ENFORCEABILITY

These General Terms and Conditions of Sale (hereinafter “T&Cs”) govern all remote orders placed on the Site by an individual acting as a consumer.

Acceptance: Any order placed on the site is subject to the full and unreserved acceptance of the T&Cs in force at the time of purchase.

Professionals: These T&Cs do not apply to professionals acting within the scope of their commercial, industrial, or artisanal activity.

The Association reserves the right to modify the T&Cs at any time. New conditions shall apply as soon as they are published online.

ARTICLE 3: PRODUCTS

The buyer is informed of the essential characteristics of each product (origin, composition, price) via a dedicated product sheet, in accordance with Article L.111-1 of the French Consumer Code.

Note: Product photographs presented on the site are non-contractual.

Promotional benefits (promo codes) are only accepted if they are specifically created for the website.

ARTICLE 4: PRICE

Prices are expressed in Euros (€) including all taxes (TTC), including the VAT in force.

They do not include preparation, transport, and delivery costs, which are calculated and indicated separately before the final validation of the order.

In the event of a promotion, the Association undertakes to apply the preferential rate within the limit of available stocks. If a product becomes unavailable after the order, the buyer will be reimbursed within 14 days.

ARTICLE 5: ORDERS

The order becomes final upon receipt of the confirmation notice and payment by email.

Validation: To validate the order, the buyer must tick the box “I accept the General Terms and Conditions of Sale”.

Once validated via the “Confirm my order” button, no modification can be taken into account (except for the exercise of the right of withdrawal).

ARTICLE 6: PAYMENT

Payment is made exclusively by credit/debit card (Visa, MasterCard, CB) via the secure interface of CRÉDIT MUTUEL.

The Association never has access to the buyer’s banking information; these are processed solely by the secure payment service.

ARTICLE 7: RIGHT OF WITHDRAWAL

In accordance with the law, the buyer has a period of 14 days after receipt of the package to change their mind.

Return Conditions:

Mandatory written notification (email or mail).
Return shipping costs are at the buyer’s expense.
Products must be unopened, undamaged, and in their original packaging.

Exclusion: The right of withdrawal does not apply to textiles that have been worn or washed (for hygiene and health protection reasons – Art. L. 221-28 of the French Consumer Code).

ARTICLE 8: INVOICING

An invoice is issued for each order and sent by email. A paper copy also accompanies the products upon delivery.

ARTICLE 9: DELIVERY

Geographical Zone: Delivery is strictly limited to Metropolitan France.

Terms: Delivery is carried out by a carrier to the address indicated, following a telephone appointment.

Claims: In case of damage or missing products, the buyer must contact the Association within 15 working days at the following email address: entonneurs-chinon@orange.fr.

ARTICLE 10: WARRANTIES

In the event of a duly noted non-conformity, the buyer may obtain a replacement or a refund for the products.

The buyer also benefits from the legal warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

ARTICLE 12: RETENTION OF TITLE

The products remain the property of the Association until full and complete payment of the price by the buyer.

ARTICLE 14: DATA PROTECTION (GDPR)

Personal data is collected solely for order management.

In accordance with the GDPR, you have the right to access, rectify, and delete your data. These rights can be exercised directly by contacting the Association by email.

ARTICLE 15: LEGAL INFORMATION

All texts and photos on the site are the exclusive property of the Association. Any reproduction, even partial, is prohibited.

ARTICLE 16: APPLICABLE LAW AND DISPUTES

These T&Cs are subject to French law.

In the event of a dispute, an amicable solution will be sought as a priority. Failing an agreement within 30 days, the dispute shall be brought before the Commercial Court of Tours (Tribunal de Commerce de Tours), which shall have sole jurisdiction.
